Topic: Cleaning up property titles – using the Court to declare rights and negotiations to agree releases
Speaker: Mr Andrew Francis, Serle Court Chambers
Synopsis: In the current market the need for clients to “clean up” their titles and remove adverse covenants at relatively little cost, especially prior to marketing or development on a tight budget, is sometimes pressing and always desirable. The talk at this seminar will deal with how this can be done. In addition the talk will focus on the proper approach to assessing the value of adverse rights (not just covenants) when negotiating release fees, or when asking the Court to assess damages in lieu of any order to enforce them. Both subjects have been the subject of very recent important authority at the highest level.
